1. Acceptance of These Terms
These Terms of Service govern your access to and use of https://70gifts.com, including purchases made through the website and related interactions with 70Gifts.
By accessing the website, submitting an order, or using our services, you agree to these Terms of Service and the policies incorporated into them. If you do not agree, do not use the website or place an order.
Nothing in these terms limits or excludes consumer rights that cannot lawfully be waived or restricted.
2. Eligibility and Lawful Use
You may use the website only if you have the legal capacity to enter into a binding agreement or are using it with the involvement and permission of a parent or legal guardian. You must use the website and its services only for lawful purposes and in accordance with these terms.
You may not use the website if your access or purchase would violate applicable law, these terms, or another 70Gifts policy.
3. About the Online Store
70Gifts is an online gift store selling physical made-to-order and printed-to-order gift products celebrating 70th birthdays, professions, retirement, hobbies, and life in one’s seventies. Products are produced or printed after an order is placed. Some products may offer personalization.
70Gifts sells to customers in the United States and international destinations available through checkout. For U.S. orders, we ship to valid addresses within the United States, including the 50 U.S. states, Washington, D.C., U.S. territories, and APO/FPO addresses where carrier delivery is available.
International shipping availability may depend on the destination address, carrier service availability, customs requirements, and checkout validation. If a shipping address cannot be verified or cannot be serviced by an available carrier, the order may not be eligible for shipment.
4. Product Information and Visual Differences
We make reasonable efforts to present product descriptions, images, mockups, sizes, colors, materials, and available personalization options accurately. Product images and mockups are provided to help customers understand the general appearance and placement of a design.
Because products are printed to order, reasonable visual differences may occur. These may include minor variations in:
- Color caused by screen settings, device displays, lighting, or printing processes
- Print size or placement
- Design alignment
- Product dimensions or appearance within reasonable production tolerances
- The appearance of a mockup compared with the physical product
These reasonable differences do not necessarily mean that a product is defective. This section does not limit rights or remedies available for a verified damaged, defective, misprinted, or incorrect product.
5. Product Sizing
Customers are responsible for selecting the correct product type, size, and other available options before submitting an order. T-shirt sizing may vary by style, cut, or product specifications.
Please review the size guide and product information displayed on the relevant product page before ordering. A size normally worn in another brand or style may not have identical measurements.
Wrong-size returns resulting from a customer’s selection are subject to the Returns and Refunds Policy. The customer is responsible for return shipping on an eligible wrong-size return, and original shipping charges are non-refundable.
6. Prices and Currency
All prices, shipping charges, taxes, refunds, and other transaction amounts are displayed and processed in United States dollars (USD).
We may change product prices or promotions at any time before an order is submitted. A price change does not affect an order that has already been accepted, except where the order involved an obvious pricing error or other circumstances described in these terms.
7. Taxes and Shipping Charges
Standard U.S. shipping is $5.99 per order. Standard international shipping is $8.99 per order.
Free standard shipping is available for eligible orders totaling $75 or more after discounts and before tax. The free-shipping threshold is calculated using the merchandise subtotal after promotional discounts or coupon codes have been applied and before sales tax, import taxes, customs duties, brokerage fees, or other government charges are added.
International orders may be subject to customs duties, import taxes, brokerage fees, VAT, GST, or other charges required by the destination country. Unless these charges are clearly collected at checkout, the customer is responsible for paying any such charges required by their country or local authorities.
8. Payment
70Gifts offers two separate payment options at checkout: PayPal and Card. PayPal payments are processed through the PayPal gateway. Payments made with the Card option are processed through Airwallex using an eligible debit or credit card.
The available payment fields and card brands are shown during checkout and may depend on the customer’s location, card issuer, device, eligibility, and transaction.
Payment is authorized or captured by the selected payment provider when the order is placed. PayPal processes PayPal payments, and Airwallex processes card payments. 70Gifts does not directly receive or store complete payment-card numbers or customers’ PayPal login credentials.
You authorize 70Gifts and the selected payment provider—PayPal or Airwallex—to process the amount shown at checkout using the payment method you select.
9. Order Submission and Acceptance
Submitting an order and receiving an automated order confirmation do not guarantee that the order has been accepted for production or fulfillment. An order is subject to successful payment, verification, availability, and compliance with these terms and our other policies.
70Gifts may decline, place on hold, or cancel an order when reasonably necessary, including when:
- The payment is declined, reversed, or cannot be verified
- The order appears suspicious, fraudulent, unauthorized, or abusive
- The product, size, design, or other requested option is unavailable
- The website displays an obvious pricing, product, or technical error
- The shipping destination is outside our supported sales market
- Personalized content violates these terms or applicable law
- The order violates a purchase restriction or another 70Gifts policy
- Information required to process or fulfill the order is inaccurate or incomplete
If an order is canceled after payment has been collected, an appropriate refund will be submitted to the original payment method.
10. Order Information
You agree to provide current, complete, and accurate information during checkout, including your name, email address, billing information, shipping address, product selections, and personalization instructions.
70Gifts is not responsible for delays, failed delivery, or production errors caused by inaccurate, incomplete, or outdated information submitted by the customer. Contact us promptly if you discover an error.
11. Order Changes and Cancellations
Requests to cancel or change an order must be submitted within 1 hour after purchase by emailing support@70gifts.com.
A request submitted within the 1-hour period is not automatically approved. Requests cannot be guaranteed after production begins because products are made to order or printed to order.
When requesting a change or cancellation, include the order number and a clear explanation of the requested action. If a requested change affects the product, personalization, price, tax, shipping information, or order total, additional action may be required before the request can be completed.
12. Production and Delivery Estimates
Orders generally require 2–5 business days for processing before shipment. Processing time does not include shipping transit time.
Estimated shipping transit time depends on the destination:
- United States: 3–10 business days after shipment
- International destinations: 10–30 business days after shipment
Total estimated delivery time, including processing and shipping transit, is:
- United States: 5–15 business days from the date the order is placed
- International destinations: 12–35 business days from the date the order is placed
Business days exclude Saturdays, Sundays, and U.S. federal holidays. Tracking information is emailed after an order ships. Production and delivery dates are estimates and are not guaranteed. Orders containing more than one product may arrive in separate packages without an additional shipping charge.
13. Shipping Policy
The 70Gifts Shipping Policy provides additional information about processing times, shipping charges, supported destinations, tracking, delivery estimates, separate packages, and shipping concerns.
The Shipping Policy is incorporated into these Terms of Service by reference. If you place an order, you also agree to the terms of the Shipping Policy.
14. Returns, Replacements, and Refunds
Return requests must be submitted within 30 calendar days after delivery. Eligibility, authorization requirements, return-shipping responsibility, replacement options, and refund processing are governed by the 70Gifts Returns and Refunds Policy.
The Returns and Refunds Policy is incorporated into these Terms of Service by reference. Customers must obtain return authorization and instructions before sending a product. Return instructions and the return destination are provided only after authorization.
Direct exchanges are not available. An eligible product may be returned, and the customer may place a new order.
15. Personalized Products and Customer Instructions
Some products may allow customers to submit names, spelling, dates, images, text, or other personalization instructions. You are responsible for reviewing all personalized information carefully before submitting the order.
70Gifts is not responsible for customer spelling mistakes, incorrect dates, low-quality or unsuitable images, inaccurate information, or unclear instructions submitted by the customer. Personalized products are not returnable for change of mind or errors in personalization information provided by the customer.
This does not limit available remedies when 70Gifts produces a product differently from the personalization information correctly submitted and accepted with the order.
16. Rights in Customer-Submitted Content
You retain any ownership rights you have in text, images, or other content that you submit for personalization. 70Gifts does not claim ownership of customer-submitted content.
By submitting content, you confirm that:
- You own the content or have the necessary permission to use and submit it
- 70Gifts and its service providers may lawfully reproduce the content on the ordered product
- The content does not infringe copyrights, trademarks, privacy rights, publicity rights, or other rights belonging to another person or organization
- The content and requested use comply with applicable law and these terms
You grant 70Gifts and the service providers involved in your order a limited license to access, reproduce, format, adjust, transmit, and use the submitted content only as reasonably necessary to produce, fulfill, ship, support, and legally administer the order.
This limited license does not transfer ownership of your content to 70Gifts.
17. Prohibited Personalized Content
You may not submit personalized content that is:
- Unlawful or intended to facilitate unlawful activity
- Infringing or unauthorized
- Hateful or unlawfully discriminatory
- Threatening, harassing, abusive, or defamatory
- Fraudulent, deceptive, or impersonating another person
- Invasive of another person’s privacy or publicity rights
- Malicious or designed to interfere with a system or service
- Otherwise inconsistent with these terms or applicable law
70Gifts may refuse, cancel, or request modification of an order containing prohibited content. A decision not to produce particular content does not create an obligation to review every personalization submission in advance.
18. 70Gifts Intellectual Property
The 70Gifts website and its original content, including its branding, graphics, text, page layouts, product presentation, and original designs, are owned by or licensed to 70Gifts and are protected by applicable intellectual-property laws.
These terms do not transfer ownership of the website or 70Gifts content to you. You may use the website only for personal shopping and other lawful, noncommercial purposes consistent with these terms.
Customer-submitted content remains subject to Section 16 and is not treated as 70Gifts-owned content merely because it is uploaded to the website or printed on an ordered product.
19. Prohibited Website Uses
You may not:
- Copy, reproduce, republish, distribute, or commercially exploit website content without authorization
- Resell or commercially reproduce 70Gifts designs without permission
- Scrape, harvest, or systematically extract website content, product information, or customer information
- Attempt to gain unauthorized access to the website, checkout, accounts, systems, or data
- Interfere with the website’s operation, security, availability, or performance
- Upload or transmit malware, malicious code, or harmful material
- Use false information, stolen payment details, or another person’s identity
- Commit or attempt fraud, chargeback abuse, return abuse, or promotional abuse
- Circumvent security, purchase, or access restrictions
- Use the website in a way that violates applicable law or another person’s rights
20. Third-Party Services and Links
The website may rely on or provide access to third-party services, including PayPal, Airwallex, analytics providers, advertising providers, fulfillment providers, shipping carriers, email providers, and fraud-prevention services.
Third-party services may be governed by their own terms and privacy policies. 70Gifts does not control every aspect of third-party platforms and is not responsible for third-party websites, content, security practices, availability, or independent actions.
A link to a third-party website does not necessarily mean that 70Gifts endorses all content, products, or services available through that website.
21. Disclaimer of Warranties
To the extent permitted by applicable law, the website and its content are provided on an “as available” basis. While 70Gifts makes reasonable efforts to maintain accurate information and reliable website operation, we do not guarantee that the website will always be uninterrupted, error-free, or free from harmful components.
Product descriptions, images, and mockups are intended to provide a reasonable representation of the products. Reasonable visual and production differences may occur as described in these terms.
Nothing in this section excludes warranties, remedies, or consumer protections that cannot lawfully be excluded. Rights relating to eligible damaged, defective, misprinted, or incorrect products are described in the Returns and Refunds Policy.
22. Limitation of Liability
To the extent permitted by applicable law, 70Gifts will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or purchase of a product when such losses were not reasonably foreseeable.
To the extent permitted by law, 70Gifts’ total liability for a claim relating to an order will not exceed the amount paid for the product or order giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence, or other matters for which applicable law does not permit a limitation. These terms do not remove non-waivable consumer rights.
23. Indemnification
To the extent permitted by law, you agree to be responsible for losses, claims, damages, or reasonable costs incurred by 70Gifts or its service providers to the extent caused by:
- Your unlawful or unauthorized use of the website
- Your material violation of these terms
- Fraudulent or abusive activity associated with your order
- Customer-submitted content that infringes another person’s rights
- Your failure to obtain permission required to submit or reproduce personalized content
This section does not require you to indemnify 70Gifts for losses caused by 70Gifts’ own unlawful conduct, gross negligence, or willful misconduct.
24. Events Beyond Reasonable Control
70Gifts is not responsible for a delay or failure caused by events beyond its reasonable control, including severe weather, natural disasters, carrier disruptions, transportation interruptions, labor disputes, government actions, widespread service outages, payment-network failures, supply disruptions, or other force majeure events.
If such an event affects an order, 70Gifts will make reasonable efforts to communicate available information and provide an appropriate resolution consistent with applicable law and our published policies.
25. Severability
If any provision of these terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the remaining terms. The remaining provisions will continue in effect.
26. Waiver
If 70Gifts does not immediately enforce a provision of these terms, that does not waive the right to enforce it later. A waiver concerning one event does not automatically waive the same or another provision concerning a different event.
27. Entire Agreement
These Terms of Service, together with the Privacy Policy, Shipping Policy, Returns and Refunds Policy, Payment Methods page, and other policies expressly incorporated by reference, form the entire agreement between you and 70Gifts concerning your use of the website and purchases from the store.
If a store policy addresses a specific subject in greater detail, that policy will apply to that subject, provided it does not remove rights that cannot lawfully be waived.
28. Changes to These Terms
70Gifts may update these Terms of Service to reflect changes in the website, products, business practices, service providers, or applicable law. The updated terms will be posted on this page with a revised “Last updated” date.
Changes apply from the stated effective date. Terms applicable to an order will generally be those in effect when the order was submitted, except where a change is required by law or agreed to by the customer.
29. Governing Law and Jurisdiction
These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where the laws of a customer’s state provide consumer protections that cannot lawfully be waived.
Any legal proceeding relating to these terms, the website, or an order may be brought before a state or federal court with appropriate jurisdiction in Virginia, subject to any non-waivable right a consumer may have to bring a claim in another court or forum.
These terms do not require mandatory arbitration and do not include a class-action waiver.
